1. Acceptance of Terms

By accessing or using Keptwell ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Keptwell is a journaling application that allows users to create memories through text, photos, and voice recordings. These memories can be designated for delivery to chosen recipients. The App is intended for personal, non-commercial use.

3. Eligibility

You must be at least 18 years old to use Keptwell. By using the App, you represent that you meet this age requirement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must provide accurate and complete information when creating an account
You must notify us immediately of any unauthorized use of your account

5. Your Content

Ownership: You retain all ownership rights to the content you create in Keptwell, including journal entries, photos, and voice recordings.

License: By using Keptwell, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service, including delivering your memories to your designated recipients.

Responsibility: You are solely responsible for the content you create. Do not upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

6. Recipient Delivery

When you designate recipients for your memories:

You confirm you have the right to share the recipient's contact information with us
You understand that delivery is subject to our verification processes
We will make reasonable efforts to deliver your memories, but cannot guarantee delivery in all circumstances
Delivered content will be retained for up to 10 years to ensure recipient access

7. Subscriptions and Payments

Keptwell offers a free tier with limited features and a premium subscription
Subscriptions are billed annually through the Apple App Store
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
You can manage and cancel subscriptions in your App Store account settings
Refunds are handled according to Apple's refund policies

8. Free Trial

We may offer a free trial period for new subscribers. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Trial eligibility is determined by the App Store and may be limited to one trial per user.

9. Prohibited Uses

You agree not to:

Use the App for any illegal purpose
Upload malicious code or attempt to compromise the App's security
Harass, abuse, or harm others through the App
Impersonate any person or entity
Use the App to spam or send unsolicited communications
Attempt to reverse engineer or extract source code from the App

10. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

11. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA OR CONTENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEPTWELL AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the App. Continued use of the App after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of Texas.
