Summary: By using Keptwell, you agree to these terms. You own your content. Creators pay $49.99/year. Viewers are always free. Subscriptions renew automatically unless cancelled.

1. Acceptance of Terms

By accessing or using Keptwell ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

Keptwell is a family voice vault application that allows users to record memories through text, photos, and voice recordings, and share them with family members. The App includes:

Viewers can upgrade to Creator status at any time to add their own voice to the family vault.

4. Eligibility

You must be at least 18 years old to create a Keptwell account. By using the App, you represent that you meet this age requirement.

Family members under 18 may be invited as Viewers by adult family members, but they cannot create independent accounts or become Creators.

Ownership: You retain all ownership rights to the content you create in Keptwell, including text entries, photos, and voice recordings.

License: By using Keptwell, you grant us a limited license to store, process, and transmit your content solely for the purpose of providing the Service, including making your memories available to your family vault members.

Family Access: By adding content to your family vault, you grant other vault members permission to view and listen to that content. You cannot restrict access to specific memories within a vault.

Responsibility: You are solely responsible for the content you create. Do not upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

7. Family Vaults

Creating a Vault

When you sign up as a Creator, you create a new family vault. You become the vault's first member and can invite others.

Inviting Family

Creators can invite family members via email. Invitations expire after 30 days. Invited members can join as Viewers (free) or Creators (paid).

Joining a Vault

When you accept an invitation, you join an existing family vault. You can only belong to one vault at a time.

Leaving a Vault

You can leave a vault at any time. If you're a Creator, your memories will remain in the vault for other family members to access. If you want your memories deleted, contact support.

8. Subscriptions and Payments

We offer a 7-day free trial for new Creator subscriptions. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Trial eligibility is determined by the App Store and may be limited to one trial per user.

10. What Happens If You Cancel

If you cancel your Creator subscription:

Your family will never lose access to your memories because of a lapsed payment.

11. Gift Memberships

You may purchase Creator memberships as gifts for others. Gift recipients receive a code to activate their Creator account. Gifted memberships are non-refundable once activated.

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

14. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE ARE NOT RESPONSIBLE FOR ANY LOSS OF DATA OR CONTENT.

While we make reasonable efforts to preserve your memories long-term, we cannot guarantee perpetual storage. We recommend keeping personal backups of important content.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEPTWELL AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

16. Data Retention

We aim to retain family vault data for at least 10 years to ensure memories can be passed down through generations. However, we reserve the right to delete inactive vaults (no active members for 5+ years) after providing notice.

17. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the App. Continued use of the App after changes constitutes acceptance of the new Terms.

18. Governing Law

These Terms are governed by the laws of the United States. Any disputes will be resolved in the courts of Texas.
